Excise Case: Delhi HC Fixes May 8 Hearing on ED Plea Challenging Bail to Arvind Kejriwal

New Delhi, Jan 13 (PTI): The Delhi High Court on Tuesday scheduled May 8 for hearing the Enforcement Directorate’s (ED) plea challenging the bail granted to former chief minister Arvind Kejriwal in the excise policy-linked money laundering case.

Justice Swarna Kanta Sharma directed that the trial court record be called in the meantime. When the matter was taken up, Kejriwal’s counsel requested a brief passover, citing the unavailability of senior counsel.

“Then we will have it some other day. Passover is not possible,” the court said, noting that it was already 3 pm, before fixing the next hearing date.

On July 12, 2024, the Supreme Court granted interim bail to the Aam Aadmi Party (AAP) chief in the money laundering case while referring three questions on the “need and necessity of arrest” under the Prevention of Money Laundering Act (PMLA) to a larger bench.

Earlier, on June 20, 2024, a trial court had granted bail to Kejriwal on a personal bond of Rs 1 lakh, but the relief was subsequently stayed by the High Court in the present proceedings.

Kejriwal was arrested by the ED on March 21, 2024, and later by the CBI on June 26, 2024, in the money laundering and corruption cases linked to the now-scrapped Delhi excise policy.

The excise policy was withdrawn in 2022 after the Delhi lieutenant governor ordered a CBI probe into alleged irregularities and corruption in its formulation and implementation. According to the CBI and the ED, the policy was modified to extend undue favours to licence holders, resulting in financial irregularities.
